There's away around this.
The reason you requested that they not have a criminal record in the first place is because their position with your company would need for them to be bonded, and with a criminal record, they would be unbondable.
There's also another way around this.
Part of their training for the job would take place in Toronto, Ontario Canada, and anyone with a criminal record would be unable to enter into Canada with a criminal record.
1 part time about 10 hours a month besides myself cleaning and wife phoning.
Maybe instead of no criminals apply I could say Must Be Bondable !! Or is that illegal?
Its certainly something that needs to be considered with future growth but it appears that the law does not currently apply to you since you have fewer than 4 employees.

Wifey will talk to a lawyer to cover all bases also find out what else can or cannot be said. Also change ad from saying M N H A C R to Back Ground Check Performed and or Must Be Bondable if I can say that. Ill keep yous posted and thanks again !!
You never discriminated against him if he didn't directly apply for the job and not get hired because of his history. IMO

He says he was ready to apply until he read Must Not Have a Criminal History as one of our demands therefore felt discriminated against.
I personally feel hes a schiester starting trouble. I dont think he was prepared to travel 50 min each way for a part time job. And if hes the same person I googled, he may be a registered sex offender and should not be around children like the customers children unless he was arrested but charges dropped which I diont know.
I don't think it matters what he was "ready to do" I have been ready to do a lot of things that I never ended up doing. Does that Mean I am still guilty of doing them ?
He screwed up by not actually applying for the job. IMO

That is pure discrimination. Can't do that it gives the opportunity to this people to try and get your hard earned money the easy way. I would be calling an attorney right now and be prepared.

It's ironic that a prospective employer can't discriminate but the federal government can. You can't cross the border if you have a criminal conviction because the government of both sides don't want to have that kind of criminal element their countries but it's ok to send these criminals into peoples homes to work.
It's really simple. You ultimately decide who you are going to hire, and that's it. No need to mention any" do not apply if's" in your ad.
Then it's up to you to sift through all who applied and make your decision for your own reasons.
There is no need to tell anyone else who applied why they didn't get the job if they were to ask you.
I wouldn't hire half you guys.
And to be fair, the other half wouldn't work for me.

Our newspapers have statements throughout the various columns that anything discriminatory will not be published??
Did you advertiser screw up in this respect??
If so, they should not have posted it & should be liable for any fines/convictions recorded against you.
Advertised it on Indeed.com and its on our employment page of our website. We are removing anything that sounds discrimination anywhere.
