The salient component to the patent is the process (and licensing of the process by the patentholder), not the device.

The E-Tes is not designed, tested, or otherwise instructed to be used for the eradication of any pests whatsoever. Therefore, it does not infringe on any patent for a "similar" product that is used, designed and patented for this purpose. Thermapure's 812 patent, entitled Method of Killing Organisms and Removal of Toxins in Enclosures, refers to the sanitizing of buildings. It does not claim that the process will dry buildings.

While a lone cleaner may escape the "radar" of a corporate patentholder, and not be subject to litigation, the cleaner should know that he can not legally "certify" that the use of a product for killing bedbugs, without U.S. EPA registration. Also there are considerations of local and state jurisdictions regarding the licensing and regulation of professional pest control. The net result is that you might invite criminal legal action, rather than civil. There is also the civil liability to the customer, who can do as little as refusing to pay, or sue for damages due to legally non-proven efficacy (in addition to no legal right to administer).
