A chick in new corolla pulled in front of me. My front end and side are pretty messed up. My vac reel is off track. No one got hurt, except my paycheck. I'm sure I will be out for 2 weeks. Her insurance has already told me they take liability of the accident.

Question? Has anyone had an accident, other persons fault, and been compensated for time off work. I will talk to adjuster on Monday and am going to ask for compensation. This is my families only income.

P.S. Just got to spend a couple days with my new greenhorn and now shut down. DAMN.

If that truck got smacked that hard that the reel is out of adjustment or maybe bent I would be looking very close at the shaft alignment and shaft trueness from the engine.

There is a strong chance that a lot of damage has been done. Some of the damage although not apparent from a cursory inspection will not show for possibly a few hundred hours. Things that will go wrong include the drive clutch, bearings, shaft etc

If it was my van I would get a very good TM professional to look real close at the unit.

Brad, that sucks. I have been on the other side of that where a company vehicle damaged a automatic carwash. We were held liable for the "potential" profit. The kicker was he was allowed to estimate his profit based on the average weekly income on his best month of the previous quarter.

If you keep good records and can show them to the adjuster you should be in good shape.

Brivik tried that when his van got rammed by a V at MF 2. he's still fighting it out if i'm not mistaken???

Triple check your frame,drive-shaft,etc.Something else must be off...

But ya there are morons driving around every corner...

P.S. your back hurts 2 right...If not still,have a chiro check you out.For possible prevention maintenance.You might have did something that comes back to haunt you.On that area,I was very stupid...Dont be...

A cleaner here spent a summer fixing up his old truck.
The following Jan a lady turned in front of him and he t-boned her. No one hurt, but his truck was "done".
Took 6 mths to get a new one on the road after all the discussions with the insurance company, he had to buy the van, the ins covered the equip.

You've been told very good advise.

If you hire an attorney you know they will take at least 40% of the settlement.

Because of experience with two accidents that were not my fault many a moon ago, I learned that if you tell the Insurance Company AFTER ALL IS SAID AND DONE, THE TM DAMAGE, THE TRUCK DAMAGE, REVENUES LOST AND BODILY INJURIES, AND DON'T SIGN OFF UNTIL YOU HAVE A COMPLETE RELEASE, ADD UP ALL THE BILLS.

EX:

Your total comes to 50,000 that would be outstanding out of pocket costs you incurred for instance. You can't claim what was actually paid for. The reason for 3 x to 4 x the amount is future possible problems with injuries, and this takes into account pain and suffering.
This is just an example: You tell the insurance Company you'll settle for $200,000.

They may come back with a counter offer, Go no less then 3 times the amount of your actually bills and prov-en losses with pain and suffering.

If they want you to settle for less than 3 times that equation, then you say I will have no choice but to hire an attorney. Guess what, more than likely they will settle because an Attorney will go for more and you'll be getting less because he will charge you 40% of the total.

Make sure you go to a Chiropractor to get all your soft tissue looked at. They can ascertain if you have injuries from this accident and prove it.

Last summer I had a small accident. I looked down to reach for my phone and did not see the guy was stopped in front of me.

I have a dimple the size of a cup in my bumper and his back tail light was broken, that was it. The cop wrote in his report that his damage was $25.00 for a back tail light. My damage was $500.00

He claimed injuries.

I just got a statement from my Insurance company they settled with him for $9,600 dollars. I was floored. I knew when he got out of his dumpy 20 year old Nissen that he was humming moving on up.

He originally was wanting to settle for $60,000.00 I was more than floored with that, I was HOT because he was taking advantage of a situation and saw that I had a company.......

I am glad the insurance company did not give into his high demand, but plenty pissed that he is getting anything more than a tail light.

Yes I hit him but geeze, not into the next county. His vehicle grunted above a fart.

But any way, just don't go to an attorney right off. You only need one really if you have disabilities from this. You can settle for what the attorney would make a claim for anyway, why should you give him anything for getting him all the information.

The insurance company will be fair and settle for at least 3 times every-time. They don't like it when you hire an attorney. Just know how to negotiated with them. If they don't want to go 3 times, then go to an attorney, he'll get 4 - 5 times with you giving him 40 %.

That's all I've got to say about that.
