You go to Amazon.com - EVERY single best selling book has raves and really bad reviews. Heck, the first page puts them side by side. Could you imagine someone suing Amazon for allowing negative posts there? Claiming they are hurting their business?

Everyone uses multiple reasons behind a buying decision - especially a significant one. Reviews, research, referrals from trusted sources, testing and trials.

If someone talks crap about you, then you allow the "happy" customers to speak up and say they are wrong. You don't file a lawsuit like a crybaby.

Piranha and myself personally have had scathing comments by a few on multiple boards for YEARS and YEARS. I remember telling my mom with "pride" how "I was called an asshole on Mikeysboard today!" She was stunned... but I laughed.

You don't see me running around threatening a lawsuit for tortious interference with our business when a few never-been-customers claim all that they claim about us and me personally. Why not?

Because... in all reality... it has absolutely ZERO impact on business.

If all of the comments are negative, that might have some small impact (or large if someone is ripping people off) - but if you are running your business right you will have multiples of happy customers to combat any unhappy vocal one, or anyone who has never bought a single thing from you, but has decided for some reason they hate you.

On the flip side TONS of people saying - "it's great, buy it!" - also has no significant impact on sales either in the positive side, if it's something more expensive than a book. It is HARD to take someone from reading about something to BUYING it. We are masters at selling at Piranha, and I'm telling you conversions on boards, yeah... not the sole strategy you want to be building your business on. You better have a comprehensive integrated online/offline marketing system in place.

Why no lawsuit filing from us? Because I track EVERYTHING. And I know livid anti-WHATEVER posts amount to no actual damage at all. Most simply spout and vent, and it does not motivate others to act on it. In fact, at least in my case, when some have written pounding posts (and that "other" board crowd is notorious for that...) - it actually boosts the click throughs to my sites, and occasionally leads to a few sales. Some of my best traffic drivers have been these "frenemy's."

The way to DRIVE sales is through actually working on your business. If yours is failing, it's not because of some random comments on a bulletin board - it's because you need to get your shit together and build better products and provide better services, and quit looking for someone else to blame for your own failures.

Lawsuits are for losers. It's their way to try to get revenue that they were not able to earn on their own. And the ones that "win" are the lawyers and the legal system built to support the parasites in this industry.

At least... that's my opinion. :shock:

I have had 3 lawsuits threatened against me. 2 since making ****** Top 25
On a profile bidmycleaning.com it said #7 Carpet Cleaner in the Nation from ****** list which was mentioned in ICS then a cease and desist was sent to me

The other was I made a point to buy cetain equipment that was CRI-SOA aproved when deciding how to tackle that issue, so on my website it says Using CRI-SOA Gold seal of approval equipment, letter stating I can't do that. I thought that was why I bought the equipment.

Moral of the story DO NOT BUY EQUIPMENT THAT IS CRI-SOA APPROVED IT DON"T MEANSHIT AND IF YOU MENTION IT IS APPROVED YOU WILL GET SUED

Yeah.... lawsuits are the lazy man's way to riches... well... at least the way to a couple bucks net after all the legal costs. Real entrepreneurs create value to earn more money, they don't try to take it from others unearned. That's the government's job.

First off Ken... laughed out loud.

Now Steve my reference was to filing suits based on the nefarious "reviews" on the Internet versus putting that energy into making your company better so any negative reviews literally don't matter.

People like to blame others when the responsibility is with the one they see in the mirror...and others are just a-holes and use litigation as a way to remove competition because they can't beat they on quality.

The legal system is meant to protect those who have been harmed...it just seems to become a popular choice of the inferior, lazy, or just "bully" big and small these days.

Going through a suit is a waste of time and money and stresses all sides. And it has a definite negative impact on this industry.

I have to say that it's good you're not actually considering a lawsuit against a never-before-been a customer for tortious interference with your business because any attorney who is worth their retainer would tell you your scenario is way off the current actionable definition of tortious interference with a business.

Ahhhh...but if I have the "blame" drive, and the target has money (or insurance), and the lawyers are on a contingency basis and I can show other examples where settlements were mad instead of a fight...I might make a little hobby of it.

Certainly beats the work of building my business through actual hard work, right?

I'm just not wired that way...and for some (I said some, not all...) this is a tactic for the ones who don't have the "game" to earn their place in the market - whether they are small fries or big bullies.

And again, that's just my opinion from litigiously promiscuous California.

An hour with one of those "attorneys" is going to be a sobering experience for this subject matter Lisa. I mean this from the bottom of my heart. The elements of interference are specific and damages are difficult to prove. That being said if you've got a case for interference and can prove some damages then why would you capitulate the issue?

Again... it's something I would not ever do. I've got thick skin - heck all business owners worth a damn have thick skin.

But in California... lots go that path to the court, or that path to the liquor store for lottery tickets. Me, I just work and earn my living. Parasites or producers. I'm in the 2nd camp.

There's a competitive pricing advantage when you don't have to stock anything and require the buyer to pay shipping on all returns

I just ordered some Pioneer Floor finish from excellent supply... Rick had it shipped direct from Pioneer $10 a case cheaper than I can get it locally.

Wouldn't anyone with self esteem feel kind of dirty taking money from a lawsuit based on things someone said about them? Those kind of people are really creepy in my opinion.

LOL... I guess I'm weird about money. When I earn it, I don't like to feel I'm tossing it away on something like the lottery. Now... if it truly led to money to schools, I might consider it as just a donation - but that was the biggest scam in CA in ages. Same with the Casinos - people wasting dollars hoping to make that big lucky score. And the average lottery winner is back to their prior net worth within 3 years of a win - because they did not have money skills to begin with.

People are really fascinating. And fairly predictable.

I know you work your ass off Lisa... so I would not put you into the category of "looking for someone else to pay my way."

Lot's of pissy pants types really are just too ignorant to understand that someone saying something negative about you isn't always actionable or even slander. Same thing with the written version of this, Liable. What's funny to me is when these clowns think they can sue because someone critiques, criticizes or trashes their company in a way in which they disagree. Apparently (judging from all the threats) there are a few fools in this industry that don't understand the first amendment. A company never has grounds to seek redress for slander or liable, it's been tried and it failed every time. Business interference gets tossed around often but that doesn't even apply to someone saying something that hurts your business (or your pissy pants feelings). Hurting your feelings, that's not a tort.

Slander & liable : has to be against an individual, proven false and proven to be done intentionally (they knew it was false and said it anyway) and done with malicious intent. Then you have to prove damages, monetary loss. Almost never happens, just gets threatened.


So let freedom ring, say what you feel and laugh at these idiots.

Think about it......

If Mike got sued everytime it was threatened, his wife would have taken his computer privileges away a long time ago.
