I can't speak for Him, but Darth Vader would have made me pay the whole amount. Any mercy shown would have been expressed by allowing it to be done in a few (as in two or three...not long term) payments.

Hmmm. Was son properly trained on this and are there written procedures in place? (If not I'm sure Steve T. has some SFS stuff that would keep this from happening again). Is son part owner of business or just an hourly wage earner (employee)? What would you do if this wasn't the son, but "just" an employee (would you make an employee pay, or chalk it up to the cost of doing business/mistakes of having employees)? My answer depends on the answers to the above....

We've had it done twice and that was on box trucks that were clearly marked and had separate tanks. He should pay it all BUT shit happens.

He already feels like a dumbass, don't kill all morale by punishing him too hard. While a bonehead move he didn't do it on purpose.

Yes 50/50 and if it will hit him hard financially I might stretch out his pay back to fit his budget.

We had it happen but we will just use a transfer pump and get it all out. Refill will just diesel and cetane additive and keep the diesel/gas mixture in a barrel to "clean" parts that are dirty or greasy so there is not mush waste.

If truck not started no big deal if he ran truck a little bigger of a deal.

I think Jehovah would say you are very blessed as his DISTRACTION happened at the pump and not while he was driving 65 mph on the freeway.

Hopefully you have not gone crazy on him already and took a minute to evaluate the situation.

Why was he mentally distracted?

Was this distraction a one time thing or is ere something going on in his personal life that has his mind spinning while he is supposed to be concentrated in his work?

Are YOU applying to much pressure on him for him to be able to handle?

Are your expectations that YOU set for him REAL and reachable?

300 or 400 dollars is way cheaper than if he was to have started that vehicle and ruined the injection pump and if he were to have crashed while being distracted with whatever distracted him when he grabbed the wrong nozzle and engage the pump to fill with gas instead of diesel.

I don't think you need to answer any of my questions here but could be a good to way to look at it. Don't go crazy and loose a second employee, that you need right now.

Will be interested to here how you handled this.

Owner pays 100%. He caught his mistake, owned up to it, and prevented it form getting worse by trying to hide it.
It is also against the law in NJ.

Your original question is flawed, because his son is perfect and would not have made the mistake.

However, we are told that Jehovah is merciful and forgives in a large way, which is a good example to follow, I think.

You could make your point by treating the event as a safety violation, and make him sit through a "training refresher". I know that would be enough for me never to make that mistake again. ...

Mine totaled out a van with a brand new truck mount in it that was 3 weeks old.
I had to buy it back from the insurance company. Cost Thousands.

WE should force both our sons to participate on the board daily as their punishment. We know how much they love it.

I have an acquaintance who owns a pest control business and hired his son to run a truck. He totalled three trucks in one year. The last one rolled backwards out of a customer's driveway (hilltop home), down a hill, and came to rest upside-down in someone's yard, where the huge tank of bug spray drained into the pool, creating a hazmat emergency response and recordable EPA incident.

His insurance finally put their foot down - fire him or ins. would be canceled.

Family - oh boy.....

Legally, nothing you can do. Pretty sure this is considered incompetence and you should train more, better.

Overall i think 99% of us should do a better job training employees. Its expensive though and we don't see a direct ROI right away.
Big payoff long term though.

I had an employee total a van/tm also, luckily insurance covered it but still created a mess.

Im sure your tank on that is huge, You should have just topped it of with Diesel and went on your way. How big is the tank anyways? My dad always mixed a little gas in with his Diesel mercedes in the winter.

About 8 years ago, my Vortex was fairly new. I pulled up to a standalone pump, that I thought was diesel, but it was actually racing fuel. I pumped about 6 gallons as I noticed the dollar amount was over $40.00. When I realized it was racing fuel, I shut my truck off immediately. I had 2- 5 gallon buckets in the back of my truck and I went and borrowed another from the gas station. I drained about 14 gallons of mixed fuel from the drain plug on the tank. We pushed the truck forward to the diesel pump, filled it up with diesel, and fired up the truck. I didn't have any lids, so I sucked the mixed fuel into the tank. Then, I went back to the shop and disposed of it in our oil bin. Cleaned up real quick and finished up the day.

If it were my son or employee, I would let it slide this time around, since I have done myself. You live and you learn.

Despite my earlier comment about what I experienced when I worked for my father, you really have no standing to have him pay for it at all. I cost my father a lot more than Davis has cost you I'm sure. Why he didn't ship me off to my teen dream career to be a field biologist is beyond me!

Lesson learned, the damage was far less than it could have been.

How about turning the tables on him and ask him what would he do if he owned the business and you as an employee made that mistake.

In Kansas money it was $125.00 for towing a box truck and $200.00 to drain and flush. That was 4-5 years ago.

If he shows remorse I'd say lesson learned. If he's casual about it and doesn't appear to own it, he need a good speech.
