When looking up coles trademark I found this slogan that a cleaner trademarked:

"XXX carpet cleaning...Because no one wants to be called a pig.TM"

Who would want to steal that slogan?

THought it was funny as hell!!

When I use to sell Rainbow vacuums years ago, my boss would tell potential customers during a home demonstration, there are only 2 kinds of people who don't buy a Rainbow, dirt poor people and filthy pigs. Nice guy. Went out of business a few months later.

I don't see this flying, the first person that he actually sues will be the last. Google pet package and tell me this is going to fly. In fact a very large multi-national hotel has a pet package involving urine removal. Sure, they are going to roll over for a bait n switch rug sucker. Any competent attorney (representing whoever Cole decides to sue) can have Mr. Cole's legal bill north of $50,000 before he even gets to trial. I can think of about 300 interrogatories and 50 pretrial motions right now.

Then there is the pissed off cleaners that get these letters, what's the chance of 5-6 of them writing letters to the criminal investigations unit of the IRS complaining about his misclassification of employees as subcontractors. The IRS has been aggressively cracking down on that and the federal tax code makes it almost impossible to do legally. I have never seen one carpet cleaner that is doing the 1099 thing stay around long. Nor have I seen a cleaner do it legitimately or legally. When the ax falls they bill you for the back taxes going back to day 1 of the business. Game over Mr. cole and fellow "misclassifiers".

By the way if you set the appointment time the technician is legally an employee. If you give him instructions or equipment to use, he is an employee.

I imagine the term "pet package" has been used years before 1999 but since the net wasn't as well used, only local advertisements would have had it. I could see him sending a letter to some cleaner thats been using it since the 80's

Is that the deep pockets Cole is after, instead of BD carpet cleaners?

To me I don't think the term is that crucial to carpet cleaning

So true. I just posted an article on this over on the now dissappeared ICS board. We are still in the middle of a mess with our State government over 1099's (not for carpet cleaning, but construction/demolition). It has cost us thousands and it ain't over. You are dead on that the IRS has for all intents and purposes made it illegal to use a sub-contractor. If you read the guidelines you wanted to hire a sub contractor, they would have to read your mind, because you cannot give ANY direction, aid, instructions or deadlines to a sub-contractor, otherwise they are deemed an employee.

I don't know how Greg has dodged this bullet for so long. You cannot set a sub-contractor's appointments or the price for the job.

Based on this and the very limited amount I know about Greg's business I would assume he is safe in the IC status he has with the companies he subs to

Ken, that readers digest version of independent contractor or not is a 50,000 ft. view at best. I'm telling you from 1st hand experience that there is a lot more to it than that. I can tell you for a fact that Cole gives more instruction to his guys than I did for the subs I used during the hurricane and got nailed for. You absolutely cannot set their schedule (and he does), or price their jobs for them (and he does). Heck, I would be willing to bet that most of his "independent contractors" work almost exclusively, if not exclusively for his company.

As our government speeds toward socialism and bankruptcy, they and states like NY who are broke already, are going to continue to crack down on sub-contrator status. The problem is, too many don't pay their taxes or do not report, so they are closing the loop on it.

It's not enough he rips off his customers and contractors in whatever region he stinks up, now he wants to screw every legitimate carpet cleaning company in America that has a web site, and he has lawyers to help him along. What a cancer he is. I'm sure Corky will be along shortly to say I'm jealous.
