Here is a link to a PDF about assessing drywall for damage. Notice it clearly states drywall must be removed when affected by sewage or flood waters.

This allows you to diagram the affected area of the walls.

Anyone who is doing water extractions in apartments and not drying to standards - you are leaving yourself wide open for big trouble. Any commercial situation in fact.

Had they had their carpet cleaner or hired restoration firm to do that and directed the work to the cheap - that company would have been co-defendant in the case for certain.

Half the resi water loss jobs we do have had previous losses - and half of those you can clearly see the firat loss was dried improperly. It is a huge problem here. As long as there is a check to cash - there is always someone willing to step out of their boundaries to cash it.

Document all you can, get "refusal of recommendations" signatures even if it's hand written.

WALL DRYING- If they cannot or do not want to have wall drying done, that’s okay, we are there to help, not to just make money off the loss. If they are non believers in wall drying, don’t get offended, just let them know they have three choices. (Only two of those are wise choices)

1) They can let us professionally dry the walls.
2) They can have the walls removed and replaced.
3) They can leave it as it is, which we do not recommend!
The probability of mold and related odors is good.
We need a release signed protecting the company, a written diagram and thermal shots if they choose this option.

We are not trying to scare them into anything, but rather save ourselves from a lawsuit.

Still a wall for lawyers to throw spaghetti at in my eyes - and my lawyers. He cited the cases and examples (which I fully ignored other than the point which was just stay away from those situations).

I do remember one of the analogies he gave me - surgeon abides by a hospital protocol that puts patient at risk. Patient is harmed due to that protocol. Hospital is the primary defendant, Dr. is the secondary.

Negligence - Dr. knew better.
