Expensive Vacuum hose

I just talked to gentleman who was looking to buy a single piece of 2" x 50' blue vacuum hose. He wanted a specific part number, no substitutions would be permitted. At first, I thought it was just a case of one to have a particular like for this hose that we've never sold before. I told him that I would have to order it, and it would take a couple of days.

He explained that his preference was a legal one.
He is an attorney, who is involved in a case where someone tripped over a vacuum hose and was suing the Carpet Cleaner. The hose is to be used as part of a demonstration. After the call, I began to ponder just how expensive that one piece of vacuum hose was going to be, for someone. He never did indicate whether he was working for the Defendant or the Plaintiff.

Has anyone here ever had an incident of tripping or complaint of hazard with your hoses? How did you handle it?

I had a lady that slipped coming down a flight of stairs and her knee came out of the socket.

She was a in a whole lot of pain.

Felt bad for her. But, my invoice releases my company from all claims.

I make sure they sign the invoive before cleaning to avoid client problems.

So, I don't get bit in the butt.

Will a disclaimer on an invoice really release a company from ALL claims?
Did a lawyer word it for you?
Does it have to be signed or initialed to be valid?

The way you stated it, it sounds as if you feel as if you are untouchable legally regarding your accountability in the event of an accident because of your invoice.
Now I am not saying you are wrong, but I would never assume anything because of a disclaimer on an invoice, but maybe only because things are "different" in New Yawk.

negligence can't be signed away. if they slipped on your hose the lawyer will make you negligent.

Dave lives in a fantasy world. It is a layer of protection, but not bullet proof..

That said, I also have a disclaimer on my invoice.

Hope I never need to see how strong it is.

Damit, I had my wife read this thread and a few responces and she's banned me from commenting. She says I can't bite on this cause there's to much manure and I'll get covered!!! But I can't help myself and I will say that you can't indemify yourself from any and all claims in any state in our union no matter how much dank you smoke.

I just put on what my lawyer suggested. Whether it is iron clad I don't know. Something is still better than nothing.

Basically it gives me the choice of remedy for all claims, instead of the client picking the remedy.

That is what you get for taking advice from a layer.. Whatever that is.

I recall a story of SS paying out a hefty amount in a lawsuit over a broken leg.


All I know is I hate warning people a million times per day, but keep on.

Always concerned about small kids as they are always 1/2 running.

And old people, their bones just snap when being looked at cross eyed..

what I find irritating is that you can PAY a lawyer to write a "disclaimer"
You explain it and have your customer sign it.
A cheating customer will PAY another lawyer to get it tossed out
and you have to PAY a lawyer to defend you.

At what point does a "signed legal" form actually mean something??!!
We live in a world where accidents are always someone "else's" fault and they should be paid off accordingly.
