Shawn probably sued Mikey for the BB drama some time ago about Vortex and now its going to court or is in court. Legally if shawn can show damage (monetary, emotional) he can sue mike for some $$$. You can have serious legal troubles for cyber bullying now. Two people just got arrested for starting a fake facebook page about someone. These old friends that did it used her info like she created it and put a cow as the profile pick. The profile went on how she is fat and likes to eat. They both got booked for doing it and their mug shot was plastered on most news stations.

Mikey, not showing a profit can be the biggest advantage in a lawsuit claiming damages. If you heard different from a lawyer I would fire him or her real quick.

But if they didn't show a profit before the "online bashing" what makes a difference!!! They would have to show a considerable decrease in profit at the time of the slandering. On the other hand a lot of people have seen a decrease in profit due to the economy... So it would be hard to pin it all on mikey! That's just my opinion... I don't know much about all the laws and statutes...

I think Mike is referring to ever, as in never a profitable project. There is more to a cost of a machine than the actual machine. The R&D, the marketing, the parts support, the technical support, the actual manufacturing and install. The manufacturer has to have all these things and be able to support their network of distributors, or its a fluke. I believe if I understand it right that Legends defense was/is its not commercially applicable to keep producing the Vortex line. Due to economy, demand, competition(aerotech) and all things I mentioned above. If they were able to show those costs,(which is possible) to the courts then Shawn doesn't really have a leg to stand on.

All of this I'm sure you know(the biz aspect), and really don't GAS But I thought I would just clear it up.

This is why law should not be practised in a carpet cleaners fantasy world. I don't have a clue as to the allegations, the real issues or anything about the topic, but I do know that anyone who believes that previous profit has anything to do with the outcome is flat out wrong.
