as many may know, the Lead Renovation Restoration and Painting Act went into effect yesterday.

I just got word from a development Co project manager that a Home Depot sub crew got busted today.
He got his info from the Home Depot regional manager

Mind your "P's" & Q's out there boys and girls if you're doing any demo or repairs in homes built before '78.

cause Big Brother is out there.
This ain't no state or local yokels either...you're dealing with Feds....
this is the Federal EPA enforcing the Act

SUBJECT LINE: Pembertons CleanTip - Special LEAD ALERT! Urgent

I am quite aware that many of us have kept employees busy during slow times
by buying old house & renovating them. Some we sell, but many of us keep the
nicer ones as rental units.

Guess what? These new regulations grab us right in the throat!

Please don't think this is just another boondogle! Already today
I am hearing of little guys getting busted! Who are the lead police?
The neighbors - employees - competitors, etc Watch yourself.

Unfortunately, it appears that only the restoration contractors in our industry
appear to be paying much attention to the new EPA Lead Regulations

April 22nd, 2010 will have a far greater impact on your business & your life than
you might initially imagine.

This is the day the EPA "Lead: Renovation, Repair and Painting Rule" or (RRP) rule
became totally effective.

Who is covered by this new (RRP) Rule?
Read it for your self http://www.epa.gov/lead/pubs/renovation.htm#owners

EPA Requirements & overview.
EPA Authorized State Programs

Information for Property Owners of Rental Housing, Child-Occupied Facilities
Property owners who perform renovation, repairs, and painting jobs in rental property should also:
# Take training to learn how to perform lead-safe work practices.
# Learn the lead laws that apply to you regarding certification and lead-safe work practices
beginning in April 2010.
# Keep records & more!

Yeah, it ain't no joke. The Fed's will be making examples out of folks. Unfortunaltely, if you've been through the class, you'll see that it has squat to do with protecting citizens and all about money for the gubment. My concern is getting the insurance compnanies to pay for the added expense.

Before long, we're not going to be able to take a dump in our own bathrooms without proper government approval.

I can't wait for a neighbor to step inside to see if I am in compliance.

this has been what I have been saying, I do all my jobs in such a way that whomever can come after me can't find I did anything wrong, they can meter the joint, whatever. if a competitor comes on your job chances are he will want to find something to talk shit about when it comes to how YOU did the job. that is just how it works, this can be alot worse if the competitor is jealous or has an axe to grind. the way people will get busted is by a competitor turning them in, they will come in tell the customer how you spread lead everywhere in the house contaminated everything etc. this is why you can't ignore this. if someone says they are going to ignore it they will probably get away with it for a while, but one day their chickens will come home to roost.

BTW, once you're certified, you're just a certified "tech".
You're still not done spending money.
cause if you do any work on a property that has any gov subsidies involved, you have to be a certified "firm"
which is simply sending a copy of your certificate ALONG WITH the cert firm application FEE of $350

from what I understand, it's taking 6 to 8 weeks for the app to be processed
