Not sure if anyone has had this issue before, but here is what is going on...
My business partners personal vehicle, a white Mazda CAR, not truck, we put logo decals on for brand recognition, like we have on the actual commercial trucks. He hit the back of a car the other day that was sticking out in the turn lane. Insurance is denying his claim to fix the car, as they are calling it a commercial vehicle. They have assigned an investigator to it. They are saying because it has the logos on it, they are considering it being used for business. Though, we absolutely don't use this vehicle for transporting employees, picking up chemicals, etc. Nothing. It's not listed on our LLC, not filed on taxes last year as a business expense. It is not listed in the business name and in his own personal name.
Do we have a case here? How else can we prove this isn't a commercial vehicle? Anyone had this issue before??
