Insurance denying claim...

Not sure if anyone has had this issue before, but here is what is going on...

My business partners personal vehicle, a white Mazda CAR, not truck, we put logo decals on for brand recognition, like we have on the actual commercial trucks. He hit the back of a car the other day that was sticking out in the turn lane. Insurance is denying his claim to fix the car, as they are calling it a commercial vehicle. They have assigned an investigator to it. They are saying because it has the logos on it, they are considering it being used for business. Though, we absolutely don't use this vehicle for transporting employees, picking up chemicals, etc. Nothing. It's not listed on our LLC, not filed on taxes last year as a business expense. It is not listed in the business name and in his own personal name.

Do we have a case here? How else can we prove this isn't a commercial vehicle? Anyone had this issue before??

I would mention to the insurance company:

Whose name is on the title, and you do not use it as a tax deduction?

Like those gals with Avon on there car are consider commercial vehicles.

i've found if you actually take yor AGENT to small claims court...they will pay up to $2000 jus to get rid of the case.....you won't be friends wit yor agent anymore but who cares....
NOW......you got a leeway of up to fi grand in small claims but they WILL bump it over to circuit court which is even better cuz then it's you against three suits wit briefcases....which the mediator hates and the mediator will lean toward yor side!

$3,700. They are attempting to total the car if the axel is bent. They won't even examine it until they can verify the correct coverage on the vehicle. They've called 4 times today and now want to cancel his rent a car until coverage is determined that it is a personal vehicle and not commercial. They called me as I'm one of the business owners and asked if we use it for commercial use and I let them know that in no way do we, besides for the advertisement of the logo on the car. He has no personal agent just whoever he has been talking to on the 800 number. So no big loss burning bridges with anyone.

let me guess...State Farm???

$3700?? they'd bump it to circuit court, as the ins co would take over from the agent...
when you sue an agent...they freak right the "f" out....

ten years ago....my insurance lapsed at 12:00 midnight....i didn't get to the office with my payment Fri like i should have.....well anyway some drunk driver knocked my car up into my front yard.......3 hrs AFTER my ins lapsed.....i sued my agent....they bumped it into circuit court thinking it would skerr me off.....
just me...three high paid lawyers and the magistrate....
The magistrate read them the riot act for wasting the courts time over three hours
felt great!!!

See if you can talk to the owner and tell them insurance won't cover it.
They can get that fixed cheaper sometimes, especially if they tell them insurance won't cover it.
Only people who win on lawsuits is lawyers.
I had a guy cut his foot on a tack strip we were doing water damage on.
Even though it wasn't our fault I called and paid the 2000$ Hospital bill.
I figured it's not worth the 2-3 months of headaches.

I remember being asked if my personal vehicle is used for work sometime. My agent advised me to say yes because of situations like this.
Picking up an employee or dropping them off, anything like that.

I've always had my Wifes (ours) car on my commercial policy, just for this very reason. I do use it to haul the Cimex ocationally, and other tools. If there's an accident, and your liable, the injured parties attorney will always note that it's commercial. Pay a little more, stay covered.
