This whole thing don't add up to me. Having been on both sides of the counter as I have said before, we are NOT being told the whole thing. I can see a mouthy pissed off cleaner shouting all kinds of threats and obscene vulgar remarks. I can see a finger pointed in a face maybe even a chest poke. I don't know whether Oklahoma is a duty to retreat state or a stand your ground so it will vary. But IF the mechanic received a threat and FELT threatened by an out of control individual controling the situation by a simple throat grab is WELL within his rights in a stand your ground state. I know this is hard to believe for many but it is true. IT WILL VARY from state to state. Florida even has laws to protect retail clerks and workers from such idiots. Freedom of speech does NOT apply to verbal assault. His reaction may have been extream OR it may have been necesary to CONTROL a lunatic. The only ones that know are the ones that were there.

I WONDER WHAT THE WITNESSES WILL SAY?

Geeze what are the chances in this industry of two guys both being jerks at the same time?

It takes a bigger man to go back and sort it out than to call the cops or a lawyer. Do it even if you feel you were wronged but not the same day. Cooler heads will previal now that all parties will have had a chance to think about where some fault might possible lie it the way they each dealt with the situation.

And another thing that any man who is on the distributor side of the shop will tell you.

Don't be breathing down the back of the neck of a tech who is working on your equipment. It pisses them off. If you have to go back there here is what I suggest

1. Ask permission first to go back in a work area
2. Explain why you want to go back there
3. Clearly show them what your exceptions are (if you need to go back there to do it) and make certain your expectations are on the work order
4. Be direct and brief being mindful of the techs time you are using
5. Then get the hell out of the shop.

When you are back to pick up the completed work (unassuming you haven't called them 5 times that day pestering about your unit) and before you leave the premises check the work. If it has been a challenging situation do so in front of an employee of the business. If you have a problem take the issue directly to the manager.

If you feel that you need to stand over a tech who is working on your truck the whole time he is working on it you either are insulting their ability by keeping your nose over their shoulder or you have enough doubts that you should find another shop.

No doubt some shops have idiots in them but there are others that could possible do better work for you.

If all else fails you can always drive your van through the front window. :lol:

According to the good people at PCS, the cops WERE called but James wouldnt stick around for them to show up! No one was choked but they were escorted out when they used the N word to the african american employee and the bill was not paid. The offer was even made to fix the beat up, well used and poorly maintenanced Avenger at NO CHARGE just to get rid of him. He apparently bought a truckmount that has seen better days, is short of money and got irrate at the wrong people. Again, I dont know him and I wasnt there, but now I have heard both sides. Let this go to court and we will find out the truth. I seriously doubt it gets that far, so the plan to finance a multistate expansion seems unlikely but maybe it could generate enough money for a english tutor or at least a GED. (just kidding, but seriously, use spell check!)

the moral of the story is basicly what Rex has been saying. And never call someone the "N" word is working on your truckmount and can kick your ass

could be it happened just like that , or it could be another case of the race card being played to try to dodge some serious trouble - after all , its fine to choke someone and use the N word as a crutch - happens ALL the time.
Im curious to see if James got medical documentation to verify his injuries. Im also wondering why PCS would didnt document any problems like severe vibration before they removed any parts - in other words , its prequalify . And why would they volunteer to fix it if they werent liable , especailly someone that was as abusive as they are saying ???

You guys are right , something STILL doesnt add up .

Didnt James say he went in to get an oil leak fixed ?? I imagine the original repair ticket could possibly confirm that .

My POINT is, it really doesn't matter what actually happened. oNly who has the most credible witnesses and what THEY say happened. Just so you know the law favors the shop keep in most states. A place of business is still private property. When instructed to leave you have to leave. Your open invitation has BEEN REVOKED. You are now trespassing.

If he really left before the cops got there and he knew they were coming he will have a hard time proving those "injuries" were not self inflicted. :shock:

It will look like he was dodgeing the legal to get to the civil. Plus he better hope there is not a SINGLE jury member that thinks like me.

i didnt read all 4 pages but you are kind of goofy..i guess things like this dont happen to me because i carry myself and handle my business in other ways that you do.
i would not allow anyone to approach me i a aggressive manner like you said he did. i think it is all in how you carry yourself and how people read you..
grow some balls and dont allow people to treat you like that.
